Terms & Conditions

1. Acceptance of Terms

By accessing or using the Added Margin website ("Site") or requesting services, you agree to these Website Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site. We may update these Terms from time to time, and your continued use of the Site after changes are posted means you accept the updated Terms.

2. Services Overview

Added Margin provides recruiting, placement, and ongoing support services to help businesses identify, evaluate, and engage remote professionals. The services described on this Site are an overview of what we offer. The specific scope, fees, deliverables, and responsibilities for any engagement are set out in a separate signed Client Service Agreement. These Terms apply to use of the Site generally and do not replace any Client Service Agreement.

3. Eligibility

You must be at least 18 years old and able to form a binding legal contract to use the Site or request our services. If you are using the Site on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Fees, Payment & Refunds

Pricing and payment terms are described in the Client Service Agreement and are summarized on our Pricing page. Unless otherwise agreed:

  • If you cancel before kickoff and before any work begins, the placement fee is refunded minus non-refundable payment-processing costs.
  • Once kickoff, role definition, sourcing, screening, interviewing, or other work begins, the placement fee is non-refundable.
  • The search may be paused once for up to 30 days.
  • Significant role changes may require revised fees and timing.
  • If candidates have already been presented and you choose not to hire, the placement fee is not refunded.

Ongoing support fees and other charges continue as described in the Client Service Agreement until terminated in accordance with those terms.

5. Client Responsibilities

As the client, you make the final hiring decision and approve all compensation, hours, duties, schedule, access, and offer terms. You are responsible for engaging and paying the placed professional directly, and for all matters related to classification, payroll, taxes, benefits, immigration, data transfers, and other legal compliance. You must provide accurate, complete information to help us evaluate the role and identify candidates, and you must comply with all applicable laws in your use of our services.

6. Service Limitations & Disclaimers

Added Margin is not an employer of record, a staffing payroll company, a law firm, a tax adviser, an insurance broker, a regulated background-check agency, or the day-to-day manager of any placed professional. We do not guarantee the performance, honesty, retention, savings, business results, or complete accuracy of candidate information. Background checks are not included unless separately agreed in writing. Search timing and candidate availability are estimates, not guarantees.

To the fullest extent permitted by law, Added Margin's liability for any claim arising out of or related to these Terms or the Site is limited to the amount you actually paid to Added Margin for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, and materials, is owned by Added Margin or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and use the Site for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, or create derivative works from Site content without our prior written permission.

8. Confidentiality

You may receive confidential information about candidates, business practices, or other proprietary information through our services. You agree to use this information solely for the purpose of evaluating or engaging candidates and not to disclose it to third parties without our consent, except as required by law. Additional confidentiality obligations may apply under the Client Service Agreement.

9. Termination

We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms. Termination of these Terms does not affect any Client Service Agreement already in place, which remains governed by its own terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state and federal courts located in Orange County, California, and you consent to that jurisdiction and venue.

If a dispute arises, the complaining party must first provide written notice describing the dispute and the requested solution. The parties will then attempt in good faith to resolve the dispute for at least 15 days before filing any court proceeding. Nothing in this section prevents either party from seeking immediate injunctive relief in court for matters involving confidential information, systems, intellectual property, candidate information, or circumvention of these Terms. In any dispute, the prevailing party may recover reasonable attorneys' fees and costs.

11. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a revised effective date. We encourage you to review these Terms periodically. Material changes may also be noted on the Site or communicated to clients where appropriate.
